1) Who we are
-------------

MDster (the “Service”) is operated by **Anesthesia Zone, LLC** (“MDster”, “we”, “us”, “our”), a Delaware limited liability company.

2) Acceptance of these Terms
----------------------------

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.

3) Eligibility (18+)
--------------------

The Service is intended for adults. You must be at least **18 years old** to create an account or use paid features.

4) Educational use only — no medical advice
-------------------------------------------

The Service provides **education** and exam-preparation materials. **It does not provide medical advice** and does not create a clinician–patient relationship.

Do not use the Service to make real-world medical or clinical decisions. Always consult appropriate, qualified professionals and follow local protocols and guidelines.

If you believe you or someone else may be experiencing a medical emergency, contact local emergency services immediately.

5) Accounts and security
------------------------

You are responsible for:

- Keeping your login credentials confidential
- All activity that occurs under your account
- Maintaining accurate account information

You must notify us promptly if you suspect unauthorized access to your account.

6) Service features, including AI features
------------------------------------------

The Service may include features powered by automated systems, including artificial intelligence (“AI Features”), for example:

- Creating, drafting, or editing study content
- Evaluating or scoring answers and generating feedback
- Creating personalized learning recommendations
- Customer-support automation (e.g., chatbots)

**AI Features can be incorrect or incomplete.** You are responsible for verifying information independently, especially before applying it in any real-world context.

You agree **not to submit patient-identifiable information or other sensitive health data** into any AI Feature or other input field.

### 6.1 Availability, changes, and feature testing

We may add, remove, modify, suspend, or discontinue any part of the Service (including Content, features, AI Features, and integrations) at any time, including without prior notice, except where notice is required by applicable law.

We may offer beta, experimental, or early-access features that may be incomplete, change frequently, or be discontinued. Beta features are provided “as is” and may have additional terms.

7) Subscriptions, billing, trial, cancellation, and renewals
------------------------------------------------------------

### 7.1 Trial

We may offer a free trial with limited duration and/or features. Trial availability and duration may vary and may be configurable.

Unless we state otherwise, a trial is provided so you can evaluate the Service before purchasing.

### 7.2 Subscription terms and auto-renewal

Paid plans are offered on a recurring subscription basis (for example **monthly, quarterly, or biannual**). Subscriptions **automatically renew** unless you cancel before the next renewal date.

We use **Stripe** (or its affiliates) to process payments. Payment method information (such as card details) is handled by Stripe; we do not store full payment card numbers on our servers.

### 7.3 Cancellation

You can cancel at any time through the **Stripe billing portal** available in your account. If you cancel, you will typically retain access until the end of the current paid period.

### 7.4 Refunds

All purchases are **final** and we **do not offer refunds** after payment is made, because the Service includes immediate access to digital content and we offer a trial to evaluate the Service in advance.

This section does not limit any **non-waivable rights** you may have under applicable law.

### 7.5 Chargebacks and payment disputes

If you initiate a chargeback or payment dispute, we may suspend or terminate your account while we investigate and/or while the dispute is pending, to protect the Service and other users.

### 7.6 Price, taxes, and plan changes

We may change our prices, subscription plans, and features at any time. Price changes will apply at renewal or as otherwise permitted by applicable law. You are responsible for any applicable taxes, fees, or charges imposed by a government authority.

8) Acceptable use
-----------------

You agree not to misuse the Service. In particular, you must not:

- Break any law or encourage illegal activity
- Harass, threaten, or discriminate against others
- Attempt to access or probe our systems without authorization
- Use the Service to upload, store, or share **patient-identifiable information**
- Scrape, crawl, harvest, or bulk-download content or user data
- Circumvent access restrictions or subscription controls
- Introduce malware or attempt credential stuffing

Additional rules are described in our **Acceptable Use Policy** and **Academic Integrity Policy**, which are incorporated by reference.

9) Academic integrity and exam security
---------------------------------------

The Service is intended to support learning, not cheating.

You must not:

- Request, share, or post “recall” or “leaked” live exam questions or answers
- Use the Service in connection with impersonation, misconduct, or exam violations

10) Content, originality, and intellectual property
---------------------------------------------------

### 10.1 Our content

The Service includes questions, explanations, analytics, audio, UI, and other materials (“Content”). Except for User Content (defined below), Content is owned by us or our licensors and is protected by intellectual property laws.

We strive to create **original** educational materials. However, Content may be similar to materials available elsewhere, and we make no representations about uniqueness. References and citations (where provided) are for transparency and internal editorial use and do not imply endorsement.

### 10.2 License to you

Subject to these Terms and your subscription status, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial educational use.

You may not copy, reproduce, distribute, publicly display, sell, or create derivative works from the Service Content unless permitted by law or with our written permission.

You may not:

- Share access credentials or allow others to access your account
- Bypass or attempt to bypass paywalls, subscription controls, or access restrictions
- Reverse engineer, decompile, or attempt to extract source code (except to the extent prohibited by law)
- Use automated means (bots, scripts, scraping tools) to access the Service except where explicitly permitted

### 10.3 Trademarks and non-affiliation

MDster and associated logos are our trademarks (or trade dress). All other trademarks belong to their respective owners.

**We are not affiliated with, endorsed by, or sponsored by any exam board, certifying body, or medical society**, and we do not guarantee that using the Service will result in passing any exam.

11) User content (comments, notes, feedback)
--------------------------------------------

You may submit content such as comments, notes, answers, prompts, feedback, and other inputs (“User Content”). You retain any ownership rights you have in your User Content, but you grant us (and our service providers and partners) a worldwide, non-exclusive, royalty-free, fully paid, sublicensable, transferable, and irrevocable license to:

- Host, store, cache, reproduce, distribute, publicly perform, publicly display, translate, modify, adapt, create derivative works from, and otherwise use your User Content
- Use your User Content to operate, provide, secure, enforce, debug, improve, market, and develop the Service (including AI Features), and to develop and improve models, algorithms, and systems

This license includes the right for us to make your User Content available to others if you choose to submit it to public or community-facing areas of the Service.

You represent that you have the rights to submit User Content and that it does not violate law or third-party rights.

We may remove or restrict User Content at our discretion (for example, for safety, policy, or legal reasons).

### 11.1 Feedback

If you provide suggestions, ideas, or feedback about the Service, you agree that we may use it without restriction or compensation to you.

12) Third-party services
------------------------

The Service may integrate with third parties (for example, payment processors, AI providers, analytics, and security services). Your use of those services may be governed by their terms.

13) Privacy, monitoring, and communications
-------------------------------------------

### 13.1 Privacy and data processing

Your use of the Service is subject to our **Privacy Policy** and **Cookie Policy**. You agree that we may process and disclose data as described in those policies, and you acknowledge that those practices may change over time.

### 13.2 Monitoring, enforcement, and disclosures

To protect the Service and users, we may monitor, review, moderate, remove, restrict, log, and analyze activity and content to the extent permitted by applicable law. We may also disclose information to law enforcement, regulators, or other third parties when we believe it is appropriate for compliance, safety, security, fraud prevention, or enforcement of our Terms and policies.

### 13.3 Electronic communications

By using the Service, you consent to receiving communications from us electronically (for example, by email, in-app messages, and notices posted in the Service). You agree that electronic communications satisfy any legal requirement that such communications be in writing.

14) Disclaimers
---------------

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT CONTENT IS COMPLETE, CURRENT, OR ERROR-FREE.

15) Limitation of liability
---------------------------

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

- WE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES
- OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE **THREE (3) MONTHS** BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) **$100**

Some jurisdictions do not allow certain limitations; in those cases, these limitations apply to the greatest extent permitted by law.

16) Indemnification
-------------------

You agree to indemnify and hold us harmless from claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Service, violation of these Terms, or infringement of third-party rights.

17) Termination
---------------

We may suspend or terminate your access to the Service if we reasonably believe you violated these Terms or if we must do so to comply with law or protect the Service.

You may stop using the Service at any time. Termination does not relieve payment obligations already incurred.

18) Dispute resolution; arbitration; class action waiver (US)
-------------------------------------------------------------

THIS SECTION APPLIES TO THE MAXIMUM EXTENT PERMITTED BY LAW. IT AFFECTS YOUR LEGAL RIGHTS AND MAY REQUIRE ARBITRATION INSTEAD OF COURT.

### 18.1 Informal resolution

Before starting a formal dispute, you agree to contact us at **** and provide a brief written description of the issue and your contact information. The parties will attempt to resolve the dispute informally for at least 30 days.

### 18.2 Binding arbitration (US)

If the parties cannot resolve a dispute informally, and you are located in the United States (or the dispute otherwise falls under the US Federal Arbitration Act), you and we agree that any dispute, claim, or controversy arising out of or relating to the Service or these Terms will be resolved by **binding arbitration**, except that either party may seek injunctive or equitable relief in a court of competent jurisdiction for alleged misuse of intellectual property or unauthorized access to the Service.

The arbitration will be conducted on an individual basis, and not as a class, consolidated, or representative action. The arbitrator may award the same damages and relief as a court, but only as needed to resolve the individual claim.

### 18.3 Class action waiver

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

### 18.4 Time limit to bring claims

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS MUST BE BROUGHT WITHIN **ONE (1) YEAR** AFTER THE CLAIM ARISES, OR IT IS PERMANENTLY BARRED.

19) Changes to the Service or Terms
-----------------------------------

We may update the Service and these Terms from time to time. We will update the “Last updated” date above when we do.

If changes are material, we may provide notice where required by applicable law (for example, by posting in the Service or by email).

20) Governing law
-----------------

These Terms are governed by the laws of the **State of Delaware, USA**, without regard to conflict-of-law principles.

If you are a consumer, mandatory consumer protections in your jurisdiction may apply and are not waived by this section.

21) Miscellaneous
-----------------

- **Force majeure**: We are not liable for delays or failures caused by events beyond our reasonable control.
- **Assignment**: You may not assign these Terms without our prior written consent; we may assign these Terms in connection with a business transfer or otherwise.
- **Severability**: If any provision is found unenforceable, the remaining provisions will remain in effect.
- **No waiver**: Our failure to enforce a provision is not a waiver of our right to do so later.
- **Entire agreement**: These Terms and the policies incorporated by reference form the entire agreement between you and us regarding the Service.
